SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE 50 U.S. OR D.C.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Texas A&M Athletics (“Administrator”).
Please direct any questions, comments, or complaints regarding the promotion to the Administrator. You understand that you are providing your information to Administrator and agencies acting on its behalf with regard to this promotion. By participating, each entrant grants Sponsor, Administrator and 12th Man Foundation permission to use his/her information (name, email, phones, etc.) for future contact, except where prohibited by law. No information collected from the sweepstakes will be sent or sold to third parties.
1. PROMOTION PERIOD:
Sweepstakes begins at 10:00:00am CDT on April 14th, 2018 and ends at 10:00:00pm CDT on April 14th, 2018 (the “Promotion Period”).
2. TO ENTER:
During the Promotion Period and while at Kyle Field, visit http://12thman.com/FBcontest. Follow the instructions to register and enter. Entries submitted from any person/email address/Facebook ID in excess of the stated limitation will be void. All entries become the property of Administrator and will not be returned or verified. Entries generated by script, macro, or other automated or mechanical means or that subverts the entry process will be void.
3. ELIGIBILITY:
Open to legal residents of the 50 United States and District of Columbia who are 18 years of age and older at time of entry, except for employees of Texas A&M University, 12th Man Foundation, Texas A&M Ventures, LLC, their affiliates, subsidiaries and agencies (collectively, the “Promotion Parties”), individuals engaged in the development, production, printing, or distribution of Sweepstakes materials, and members of their immediate family or persons living in the same household. Sweepstakes is subject to all applicable federal, state and local laws.
4. WINNER SELECTION
Potential winner(s) will be selected in a random drawing to be conducted after the Texas A&M football spring game on April 14th, 2018. Administrator, whose decisions are final and binding in all matters, will contact winners. Odds of winning depend upon number of eligible entries received. Potential winners will be notified by email or phone. Failure to respond to the notification of winning within the specified time period in the notification, the return of any prize notification as undeliverable, Administrator’s inability to contact a potential winner within a reasonable time period or noncompliance with these Official Rules may result in disqualification and, at Administrator’s sole discretion, an alternate winner may be selected for the drawing.
5. PRIZES
Prize: Official Texas A&M Football helmet autographed by head coach Jimbo Fisher. Total fair market value of prize(s): $500.
Sponsor reserves the right to substitute prizes (or a portion thereof) of equal or greater value. No substitutions or transfers of prize(s) are permitted by the winner(s), except at Sponsor’s sole discretion.
All taxes and all other costs associated with acceptance or use of the above prize(s) are the sole responsibility of the applicable winner.
6. RELEASE OF LIABILITY AND PUBLICITY:
All prize winners consent to the use of their names, photographs, likenesses and limited biographical information for publicity or advertising purposes without further compensation, where permitted by law. By entering the Sweepstakes, entrants agree to have their submitted photograph displayed on the Administrator website and used by Administrator for any purpose, at any time, without any fee or other form of compensation. All entrants release Sponsor, Administrator, and each of their respective parents, affiliates, subsidiaries, officers, directors, partners, equity holders, agents, employees, and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”), from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, damages, death or monetary loss. Sponsor assumes no responsibility for any injury, loss or damage to entrants’ or to any other person’s computer relating to, or resulting from, entering or downloading any information or software in connection with this Sweepstakes. Sponsor and its agents are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or late, failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user, or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any human or other errors that may occur in connection with this Sweepstakes.
7. GENERAL RULES:
Entries that fail to comply with these Official Rules may be disqualified. The Released Parties are not responsible for lost, illegible, late, delayed or misdirected mail or email or other communications, or for any error in the printing or interpretation of the offer, the administration of the Sweepstakes, or in any announcement of the winners or prizes. In no event will the Released Parties be liable for more than the value of the stated prizes in Rule 5. No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable except at sole discretion of Sponsor. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes, in its entirety or in part, should tampering, unauthorized intervention, counterfeiting, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of the Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement, or any other unfair playing practices, poor sportsmanship, or intending to annoy, abuse, threaten, or harass any other participants or Sponsor representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE Sweepstakes MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE Sweepstakes. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Texas A&M Athletics reserves the right to change, modify or otherwise alter this Policy at any time.
Texas A&M Athletics does not provide support for client hardware or software. If users of the WiFi are in any doubt as to how to maintain their particular client device, they must contact their IT support resources directly.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
TEXAS A&M ATHLETICS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER TEXAS A&M ATHLETICS, NOR ANY OF ITS PARENTS, PARTNERS, AFFILIATES, SUBSIDIARIES, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OPERATIONAL OR PROMOTIONAL PROVIDERS, AND OTHER VENDORS THAT ASSIST IN PROVIDING THE WIFI, ARE LIABLE OR SHALL HAVE RESPONSIBILITY OF ANY KIND TO ANY USER FOR ANY LOSS OR DAMAGE THAT A USER INCURS IN THE EVENT OF (A) ANY FAILURE OR INTERRUPTION OF THE WIFI; OR (B) ANY OTHER CAUSE RELATING TO USER'S ACCESS OR USE, OR INABILITY TO ACCESS OR USE, THE WIFI, WHETHER OR NOT THE CIRCUMSTANCES GIVING RISE TO SUCH CAUSE MAY HAVE BEEN WITHIN THE CONTROL OF THE TEXAS A&M ATHLETICS OR ANY VENDOR PROVIDING SOFTWARE, HARDWARE, SERVICES OR SUPPORT. IN NO EVENT WILL TEXAS A&M ATHLETICS, ITS PARENTS, PARTNERS, AFFILIATES, SUBSIDIARIES, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OPERATIONAL OR PROMOTIONAL PROVIDERS, AND OTHER VENDORS THAT ASSIST IN PROVIDING THE WIFI BE LIABLE TO ANY USER FOR ANY DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES OR ANY OTHER LOSS OR DAMAGES OF ANY KIND EVEN IF TEXAS A&M ATHLETICS, ITS AFFILIATES OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY THEREOF.
LIABILITY OF WIFI USERS
WIFI USERS HAVE SOLE RESPONSIBILITY FOR ADEQUATE PROTECTION AND BACKUP OF DATA AND/OR EQUIPMENT USED IN CONNECTION WITH THE WIFI AND WILL NOT MAKE A CLAIM AGAINST THE Texas A&M Athletics RELATED TO LOST DATA, RE-RUN TIME, INACCURATE OUTPUT, WORK DELAYS OR LOST PROFITS RESULTING FROM THE USE OF THE WIFI.
Termination
Any conduct that violates this Policy, or any additional posted policies or requirements, in any way may result in the termination of your access to the WiFi, in Texas A&M Athletics' sole discretion, in addition to any other legal remedies.
Indemnification
You agree to indemnify and hold harmless Texas A&M Athletics, its parents, partners affiliates, subsidiaries, members, directors, officers, employees, agents, operational or promotional providers, and any other vendors that assist in providing the WiFi from and against all liabilities, claims, damages and expenses, including attorney's fees, due to or arising out of: (a) your use of the WiFi; (b) content you submit, post, transmit or otherwise make available through the WiFi; or (c) your violation or alleged violation of this Policy.
Choice of Law and Forum
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, excluding its conflicts of law rules. Any dispute arising out of or relating to this Policy or your access or use of the WiFi will be subject to the exclusive jurisdiction of the courts located within the state of Texas, and you hereby submit to the personal jurisdiction of such courts. If any provision in this Policy is held invalid or unenforceable, that provision shall be construed in a manner consistent with applicable law to reflect the original intent of the provision, and the remaining provisions of these Terms shall remain in full force and effect.
